Section 9.5and 9.8 of the Ontario Fire Code are fairly new sections of the code (1994) they deals with the upgrading of accessory apartments. Examples of accessory apartments include Basement apartments situated in a single family home; two residential units side by side with a common entrance area, and a building with two apartments situated one on top of each other. The owners of these buildings must ensure that exiting, annunciation, suppression, containment and the electrical system meet the minimum life safety requirements as set out in section 9.8 of the code. The Pembroke Fire Department will assist the owners to achieve compliance by providing code knowledge and supply guidance in situations that may be difficult to comply with.
BUILDINGS UP TO AND INCLUDING SIX STOREYS IN BUILDING HEIGHT WITH RESIDENTIAL OCCUPANCIES
9.5 This Section applies to buildings up to and including six storeys in building height with residential occupancies and containing
(a) more than two dwelling units where
(i) at least two dwelling units share common exit facilities and have interioraccess to one another,
(ii) there is at least one dwelling unit located above another with interior access to one another, or
(iii) there is at least one dwelling unit located above another and the dwelling units share common exit facilities,(b) sleeping accommodation for more than ten persons, in one or more dormitories,
(c) boarding, lodging or rooming accommodation for more than three persons where Sections 9.3 and 9.4. do not apply, or
(d) one or two dwelling units in combination with boarding, lodging or rooming accommodation for two or three persons, excluding the operator's residence.
TWO UNIT RESIDENTIAL OCCUPANCIES
9.8 This Section applies to a detached house, semi-detached house or row house containing 2 existing dwelling units, where
(a) the building is 3 storeys or less in building height,
(b) the building area does not exceed 600 m2, and
(c) one dwelling unit or a portion of a dwelling unit is situated above another dwelling unit, or two dwelling units side by side share a common interior means of escape.
